1. Agreement & Acceptance

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "the user") and Harish Chandran ("Licensor", "we", or "us") for the use of the Sous-e mobile application, including all associated software, content, recipes, and updates (the "App"). By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this Agreement, Harish Chandran grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App for your personal, non-commercial purposes on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple App Store Terms of Service. This licence does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

3. Restrictions

You agree not to, and not to permit others to: (a) copy, modify, adapt, translate, or create derivative works of the App; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent such restriction is prohibited by applicable law; (c) rent, lease, lend, sell, sublicense, assign, distribute, or otherwise commercially exploit the App; (d) remove, alter, or obscure any proprietary notices; or (e) use the App for any unlawful, harmful, or fraudulent purpose.

4. Subscriptions & In-App Purchases

The App offers optional paid subscriptions ("Premium") that unlock additional features. Subscriptions are billed to your Apple ID account at confirmation of purchase. Unless auto-renew is turned off at least 24 hours before the end of the current period, the subscription automatically renews and your Apple ID is charged for the renewal. You can manage or cancel your subscription, and turn off auto-renewal, in your device's account settings after purchase. All payments are processed by Apple in accordance with Apple's terms; Harish Chandran does not receive or store your payment card details.

5. Ownership & Intellectual Property

The App and all of its content - including recipes, voice guides, text, graphics, user interface, design, and software - are owned by Harish Chandran or its licensors and are protected by intellectual property laws. This Agreement grants you a licence to use the App; it does not transfer any ownership rights to you. All rights not expressly granted are reserved by Harish Chandran.

6. User Content & Data

The App stores your profile and preferences to provide its features. We handle your information in accordance with our Data Privacy & Security policy, available within the App. In summary, we do not collect or store personal data beyond what is strictly necessary for authentication and app functionality. You are responsible for any content you provide and for keeping your account credentials secure.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any recipe, nutritional, or cooking information will be accurate, complete, or suitable for your needs. Nutritional values and cooking guidance are provided for general informational purposes only and are not a substitute for professional dietary, medical, or allergy advice. Always consult a qualified professional and verify ingredients for allergens before cooking or consuming.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Harish Chandran and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of, or inability to use, the App, even if advised of the possibility of such damages.

9. Term & Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically, without notice, if you fail to comply with any of its terms, or upon deletion of your account or removal of the App. Upon termination, you must cease all use of the App and delete all copies. Sections that by their nature should survive termination will survive.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to this Agreement or the App shall be subject to the applicable courts having jurisdiction in India.

11. Changes to this Agreement

We may update this Agreement from time to time. When we do, we will revise the "Last updated" date at the top of this document. Your continued use of the App after any changes take effect constitutes your acceptance of the revised Agreement.

13. Apple-Specific Terms

The following terms apply to your use of the App on Apple devices and take precedence over any conflicting terms in this Agreement:

(a) This Agreement is concluded between you and Harish Chandran only, and not with Apple Inc. ("Apple"). Harish Chandran, not Apple, is solely responsible for the App and its content.

(b) The licence granted to you for the App is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

(d) Apple is not responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.

(e) Harish Chandran, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

(f) In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Harish Chandran, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

(g) You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

(h) You must comply with applicable third-party terms of agreement when using the App.

(i) Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
